They sued these states because they wanted to challenge the constitutionality of the states bans on same-sex marriage and refusal to recognize legal same-sex marriages. The plaintiffs argued that the states statutes violated the Equal Protection Clause and Due Process Clause of the 14th Amendment. This was a huge case in terms of Kennedys decision. Kennedy wrote the majority decision in which the vote was 5-4. Kennedy was ultimately the deciding vote and in conclusion he said same-sex couples respect marriage and ask for equal dignity in the eye of the law. He claimed that right was granted by the Constitution. He says in the case, No union is more profound than marriage, for it embodies the highest ideals of love, fidelity, devotion, sacrifice, and family. Throughout his career he was mainly conservative, but in this case, he was sided by four liberal justices making the majority vote 5-4. Without Kennedy in this case and his individual approach to each issue, same-sex marriage may not be legal today. Another Supreme Court case where Kennedy made a huge impact is in the Planned Parenthood of Southeastern Pennsylvania v. Casey. This case took place in 1992 and Kennedy played a huge role in the decision of this case. During this time, the Pennsylvania legislature amended its abortion control law in 1988 and 1989, and among the new provisions, the law required a 24-hour waiting period before the procedure can happen. Minors were required to get consent of at least one parent if seeking an abortion. A married woman had to indicate that she notified her husband that she wanted to get an abortion. These rules and provisions were challenged by several physicians and abortion clinics. This case is directly related to Roe v. Wade (1973) because in this case, they were given the right to abortion. The question in this case is whether a state can require women who want an abortion to obtain informed consent, wait 24 hours, if married, notify their husbands, and, if minors, obtain parental co nsent, without violating their right to abortion as guaranteed by Roe v. Wade? Kennedy was a part of the majority opinion and the ruling was 5-4, in affirmation of Roe v. Wade. They declared that a womans decision to get an abortion implicates important liberty interests and privacy interests that the Constitutions Due Process Clause protects against state interference. These interests form a substantive right to privacy that is protected from state interference in marriage, procreation, contraception, family relationships, child rearing, and education. The court argued that these rights also protect the abortion decision. They then reaffirmed that states could not ban abortions before the viability point, and in no case, may states ban abortions that help preserve the life or health of the mother. When looking at Pennsylvanias provisions on abortion, they only determined that the requirement to notify the husband is unconstitutional. The other provisions were deemed constitutional. Kennedy co-authored this opinion with Justices Sandra Day OConnor and David Souter. As Kennedy is mainly conservative, choosing this majority side is another example of him being the controversial swing vote. Kennedy did choose in affirmation of Roe v. Wade in this case, but his record on abortion-related matters has varied. He consistently voted in favor of pro-life protestors and against laws aimed at protecting women seeking abortions from harassment. He also had some controversial decisions when siding with abortion opponents dealing with partial-birth abortions. Although, in this case specifically, his swing vote was the decisive vote. Many were outraged, but because of his case-by-case approach and his ideology, he chose what he believed was best. Fisher v. University of Texas was another case where Kennedy played a crucial role. Kennedy delivered the opinion for the 7-1 majority. The Texas legislature had previously enacted a law that required the University of Texas to admit all high school seniors who ranked in the top ten percent of their high school classes. The University of Texas found differences in in the racial and ethnic makeup of the universitys undergraduate population and the states population. The university then decided to modify their race-neutral admissions policy which said that they will continue to allow students in the top ten percent of their high school classes in, but for the remainder of students who are outside of that range; the university would consider race as a factor in admission. Abigail Fisher, a Caucasian female, applied to the University of Texas and was not in the top ten percent of her high school class. She was denied by the university. She then filed suit against the university because s he claimed that the use of race as a consideration in admission decision was a violation of the equal protection clause of the 14th Amendment. Kennedy played a major role in this case. His decision was very unexpected which made it that much more impactful. His vote, along with the other justices, essentially denied a challenge to a race-conscious admissions program at the University of Texas. Kennedy had never voted previously to uphold an affirmative action plan. In fact, he has dissented in prior cases about affirmative action. He explained how universities are owed considerable deference when defining those characteristics, like the study body diversity. I believe that decision is odd on his part, due to him not ever voting for affirmative action, but I personally agree with this statement in that universities should have the right to decide who gets accepted. If the university wants to make it more diverse, then they should be allowed to reject people they want and accept different race and ethnic backgrounds. I believe that is a huge problem in todays society. LVC is a predominant white school and it lacks diversity. LVC has taken steps forward to try to get more culture and diversity, but not much has worked. In my opinion, it all depends on the environment which you grew up in and where you grew up. These factors are usually determinants in if you will value higher education. I believe Kennedy upheld the affirmative action because he believes that diversity is a problem in the education system. He once said, it remains an enduring challenge to our nations education system to reconcile the pursuit of diversity with the constitutional promise of equal treatment and dignity. Bush v. Gore is one of the most important cases in U.S. history because it essentially decided the presidency. Some say that Kennedy was the swing vote that allowed this to happen, although this case was a per curiam decision. During the election, there were demanded recounts ordered by the Florida Supreme Court, that all counties in Florida must immediately begin manually recounting all under votes. At the time Governor George Bush, filed a request for review in the Supreme Court and sought an emergency petition for a stay of the Floridas Supreme Courts decision. The per curiam decision held that the recounting ballot was unconstitutional, and they said that no constitutional recount could be done in the time remaining. Kennedy is controversial in this case because along with Justice Sandra Day OConnor, were the only two justices whose names did not appear separately on any of the other opinions, signaling that one or either wrote the unsigned majority opinion. I agree with the court in their decision to write the opinon per curiam. I agree with this because having your name linked to going against the potential president of the United States does not look good for you. Although, it is known and there is a very high chance that Kennedy wrote the majority opinion that basically sent George Bush into office. Kennedy was the decisive vote from the bench that made this happen. Capital punishment is a subject that Kennedy did not shy away from. He has had some very important votes and rulings in capital punishment cases. I will be discussing his impact on Kennedy v. Louisiana and Roper v. Simmons. In both of these cases, Kennedy was thoughtful towards capital punishment. Kennedy v. Louisiana found Patrick Kennedy guilty of raping his eight-year-old step daughter. Louisiana law states that the death penalty can be enforced to those found guilty in the raping of children under the age of twelve. Patrick Kennedy was given the death sentence and he appealed the decision. Louisiana believed that their sentence of the death penalty was justified due to similar laws in five other states and because of the vulnerability of a child. Patrick Kennedy argued that five states do not constitute a national consensus for the purposes of the Eighth Amendment, and he believed the law was singling out black child rapists as opposed to white child rapists. Justice Kennedy wrote the majority opinion which was a 5-4 decision. This decision was in favor of overturning the death penalty laws in Louisiana and the five other states. In the majority opinion Kennedy said there was a distinction between intentional first-degree murder on the one hand and non-homicide crimes against individual persons even devastating crimes like the rape of a child, on the other. Kennedy believes that the courts jurisprudence on the death penalty remains sound. Kennedy reasons for voting against the death penalty had to do with how the five other states laws were, as in they had to have a prior rape conviction in order to be subject to the death penalty. Also, he said how the death penalty presented problems when dealing with children. The problem was with special risks of an unreliable testimony by children and that crime often happens within the family. This could lead to the problem of underreporting of these crimes because they know the punishment; they mig ht want to protect a family member since the penalty is so severe. Being in Kennedys position here would be very tough for many people. Everyone wants justice, but many problems arise when enacting a death penalty sentence. Personally, in this situation with the rape of a child, I believe the death penalty is appropriate. I think keeping someone through the prison system would ultimately cost more money as opposed to their death. Especially since laws were already in place, I believe they should have been followed through. Kennedys impact on this case decided the life of a man. If that is not impactful, then I do not know what is. The other capital punishment case I am going to talk about is Roper v. Simmons. This case took place before the previous case discussed. This case is about a 17-year-old boy named Christopher Simmons, who was sentenced to death in 1993. Then, in 2002, the Missouri Supreme Court reconsidered Simmons execution after ruling that sentencing the mentally disabled to death was against the 8th and 14th Amendment. Missouri saw that national opinion has changed and they decided to say these laws that allows the sentence of the death penalty to a minor is unconstitutional. On appeal to the Supreme Court, the government argued that allowing a state to overturn the Supreme Court due to evolving standards is very dangerous. In a 5-4 majority opinion written by Justice Kennedy, he was again the deciding factor on another controversial case. He sided with the liberal bloc on this and said that standards of decency have evolved so that executing minors is cruel and unusual punishment prohibited by the Eighth Amendment. The court also looked out the international opinion against the death penalty. The U.S. was the last country to put this law into place. Although Kennedy voting against capital punishment here, he once before voted for it against juvenile offenders, but he is a believer of the evolving standards. Kennedys views and rulings on capital punishment will go far beyond his years. His swing vote in this case was another decisive vote that essentially made another law preventing the death penalty being places on minors. I am in full acceptance of this because I am with Kennedy in the fact that young people are still developing and should not be held accountable at that level. I do believe in justice, but executing a minor would be against what I would want and now because of the evolving standards; against what Kennedy wants. The next case I will talk about is a gun rights case that took place in 2008, District of Columbia v. Heller. In this case, Kennedy was the swing vote yet again. This case was about how the District of Columbia made it illegal to carry an unregistered firearm and prohibited the registrations of handguns, so essentially there was no compromise to be able to carry a handgun. The only exception is if the chief of police authorized you a one-year license to carry. The law also said how if you did legally own one, it had to be unloaded and disassembled. Dick Anthony Heller was a District of Columbia special police officer who was authorized to carry a gun on duty. He applied for a one-year personal handgun that he could keep at home and was denied. He sued the District of Columbia. He argued that these laws violated his Second Amendment. He wanted one for self-defense at home and since the gun had to be disassembled, he argued that violated his rights. Kennedys role in this case was crucial in the 5-4 majority opinion. He was the swing vote that essentially lifted the ban on guns in D.C. He believed, just like the four other justices that citizens should have the right to bear arms and that they should have the right to self-defense at home. The court made references to a militia but these justices agree that should not be confined to just people in the military because the term once referred to all able-bodied men who were capable of being called to such service. Kennedy was the ultimate swing vote during his time when dealing with gun rights. Other than this case, Kennedy was also in support of the McDonald decision that recognized an individual to bear arms both in and outside the home. However, since that case in 2010, the Supreme Court has declined to take any Second Amendment cases in almost a decade. Many think, that Kennedy had lost his appetite for future gun rights cases. I believe this could have been since Kennedy knew he was nearing his retirement, he would not vote to hear these cases because of the controversy they cause. Gun rights is a huge and sensitive subject in the United States today. All the mass shootings and other shootings going on today, make this subject very sensitive to many Americans. I do not agree with them almost ignoring the subject and not hearing these cases, but I do understand why Kennedy does not want to hear these cases. Also, with Kennedy being the swing vote so much backlash would come back on him in whatever decision he would make. If he goes for stronger gun rights, it upsets people and if he is against it, it upsets people. There is really no good choice for Kennedy in gun rights cases. The last case I will be writing about where Kennedy played a major role is Citizens United v. FEC. In this case, Citizens United sought an injunction against the FEC to prevent the application of the Bipartisan Campaign Reform to its film Hillary: The Movie. This movie basically explains how she would be a good president. Federal law sets strict limits on the ability of corporations and unions to spend and attempt to influence elections. Whether it be the controversy surrounding Elvis' swinging hips, the Doors' suggestive lyrics, or Alice Cooper's stage antics, this controversy always seems to be followed by undue criticism from the media. One form of musical expression that has been in the news recently because of its negative attention is hip-hop. Rap, a relatively new form of musical exposition, has been criticized for its so-called anti-women lyrics. Some have even said that these types of lyrics are veering toward rape music (Faludi 267). This is just simply not true. Once thought of as a passing fad, rap has been able to fabricate many facets of popular culture. Due to their raw and insouciant lyrics, many artists have met opposition by conservative groups that believe rap spreads an anti-women message. These groups argue that the lyrics in many rap songs degrade women by calling them bitches, hoes, and tricks. These words, however, do little more than sell records. It is the image that rap artists represent as a whole that the youth of America buy. Although these terms may sound degrading, these lyrics have no real influence on America's image of women. These words are just a tool of the musicians that helps give them an appearance of being Benninger 2 gangsters, pimps, or dealers. It is these types of people that represent power and control to some or a glimpse into an unknown world to others. Either way, this image is what makes money. Further proof that rap artists are selling an image and not real life is that many rap artists are happily married men with wives and children that they truly care about. Dr. Dre, one of the forefathers of hardcore rap, in an interview with MTV, readily admitted that what he sells in his music is not a life that he himself wishes to live. He, like many other rap artists, does not view women as derogatory sex objects as they are depicted in his lyrics (MTV 3). Songs such as Bitchez [sic] ain't Shit and Bridget in which women are referred to as hoes do not really represent how Dr. Dre and many other rap artists feel about women. Dre said, people buy the type of music that I make. As long as people keep buying it, I will keep making it (MTV 2). Linda Tuzynski, a mother of six and housewife, sees no problem with rap music. It's just a image. No one really thinks of their mothers, wives, girlfriends, or daughters as bitches or hoes. She says the only issue she has with rap music is young children listening to it. But, she says, as long as parents monitor what their children listen to when they are too young, it is not a problem. Society has always been able to move on and eventually accept different ways of expressing oneself, and hip-hop should be no different. Although the message may not be the best one, each musician has the right to say whatever he or she feels. Rap music has no real influence on the image America has of women. In this age of enlightenment Benninger 3 toward the images and ideas the media present, the only real image America should have of women is the image that women themselves furnish. These groups that bash rap music and tell people to avoid it because of its negative reflection on woman are missing the big picture. Lesson Plans for Eid al Adhaa Muslim Holiday Celebration Eid al Adha is perhaps the most joyful of Muslim holidays. Coming at the end of the Hajj, it is a family celebration involving gift giving and gathering as a family. This part of the unit introduces the core beliefââ¬â¢s of Islam, the specifics of Eid al Adha, and celebrates the cultural differences of two cultures. If you have a Mosque in your community, I would suggest contacting them to find a speaker. Or, you can invite a Muslim that you know to come and speak about how their family celebrates Eid al Adha. They will be thrilled that you recognize the importance of this festival. Day 1: An introduction to Islam and to the Festival Objective: Students will be able to identify Ibrahim, Ishmael and Eid al Adha. Procedure: Do a KWL chart: What do you know about Islam? You students are likely to know very little, and it may negative. How you respond to that will have to do with the ability of your students: You can find majority Muslim countries on a map. You can find pictures on Google Images. Tell the following stories: Muslims believe that many years ago God, or Allah, sent an angel to a man named Mohammed who lived in Mecca in what is not Saudi Arabia. Ibrahim was chosen by Allah to share the word of the Unity of God. He had a single son, Ishmael. The Koran tells the story of how Ibrahim was commanded by God to take his son, Ishmael, to the mountaintop and there to sacrifice him to Allah. Allah wanted Ibrahim to prove to him that he truly was obedient. Ibrahim took his son to the mountain with a heavy heart. He built a fire. He bound Ishmael. As he was about to kill his son, Allah sent Gibril, a messenger angel, to stop him. He brought the message that by being obedient, Ibrahim had truly made a sacrifice. Muslim people gather in the Mosque to remember Ibrahimââ¬â¢s sacrifice. They gather in their homes later to feast and to share gifts. Evaluation: Make the following cards for your word wall: Allah, Islam, Mohammed, Eid al Adha, Ibrahim, Ishmael. Identify the Cards: Mohammed is the Prophet of Allah. Islam is the name of the religion of those who believe in the teachings of Mohammed and the Koran Eid al Adha is a family celebration. Kurt Vonnegut Coming from a German background, the first thing I thought of was the name of a writer that had written one of my favorite books. I went onto the internet to try to find out if he had in fact come from the same origin as my family. This was tough at first because the only thing it revealed was that Kurt Vonnegut was born in Indiana on November 11, 1922 (Grolier Incorporated). After looking to find out where his great-grandfather came from, it revealed that Clemens Vonnegut Sr. emigrated from Germany in 1848 (Shaping the Circle). I picked writing about this writer because he has written one of the most interesting books in my mind, Slaughterhouse-Five which I will use as my topic. In the book many different adventures take place that makes this novel have a different feel. The adventures that take place happen for a multitude of reasons. It gives this book a twist in a way that you seem to have an outside view of what is going on in the plot. Billy's memories and his stream of consciousness are used to give sensory impressions of his actions and thoughts by his time travel, as well as also provide other details in his life and World War II (Schatt 89). Billy encounters a sleep-like state when he becomes ââ¬Å"unstuck in time (Vonnegut 29)â⬠and this occurs for different reasons. One of the major reasons for Billy to become ââ¬Å"unstuck in timeâ⬠is the atrocities of the Holocaust, together with the firebombing of Dresden, make for such painful memories. ââ¬Å"Because of the shock of this event, Billy becomes a perpetual prisoner of war, returning again and again in his mind to this scene (ââ¬Å"Slaughterhouse-Five, or the Children's Crusadeâ⬠).â⬠Within the book, Dresden seems to be the center of all the major action taking place. It is no wonder almost all Billy's thoughts is his remembrance of his wartime encounters during his captivation as a prisoner. Kurt Vonnegut then has Billy put into the sleep-like state in which he only remembers pieces at a time to put his mind more at ease. This method makes the story rather confusing, but puts what is going on more into perspective. Billy encounters a sleep-like state when he becomes ââ¬Å"unstuck in time (Vonnegut 29)â⬠and this occurs for different reasons. One of the major reasons for Billy to become ââ¬Å"unstuck in timeâ⬠is the atrocities of the Holocaust, together with the firebombing of Dresden, make for such painful memories. ââ¬Å"Because of the shock of this event, Billy becomes a perpetual prisoner of war, returning again and again in his mind to this scene (ââ¬Å"Slaughterhouse-Five, or the Children's Crusadeâ⬠).â⬠Within the book, Dresden seems to be the center of all the major action taking place. It is no wonder almost all Billy's thoughts is his remembrance of his wartime encounters during his captivation as a prisoner. Kurt Vonnegut then has Billy put into the sleep-like state in which he only remembers pieces at a time to put his mind more at ease. This method makes the story rather confusing, but puts what is going on more into perspective. It shows how a man th at experienced such a catastrophe might have to deal with what he went through by his thoughts (Schatt 88-89).

General Albert Sidney Johnston in the Civil War
A Kentucky native, General Albert Sidney Johnston was a notable Confederate commander during the early months of the Civil War. After graduating from West Point in 1826, he later moved to Texas and joined the Texas Army where he acted as aide-de-camp to General Sam Houston. Following service in the Mexican-American War, Johnston returned to the US Army and was commanding the Department of California when the Civil War began. He soon accepted a commission as a general in the Confederate Army and was tasked with defending the region between the Appalachian Mountains and the Mississippi River. Considered one of the finest officers available at the start of the war, Johnston was mortally wounded at the Battle of Shiloh in April 1862. Early Life Born in Washington, KY on February 2, 1803, Albert Sidney Johnston was the youngest son of John and Abigail Harris Johnston. Educated locally through his younger years, Johnston enrolled at Transylvania University in the 1820s. While there he befriended the future president of the Confederacy, Jefferson Davis. Like his friend, Johnston soon transferred from Transylvania to US Military Academy at West Point. Two years Davis junior, he graduated in 1826, ranked eighth in a class of forty-one. Accepting a commission as a brevet second lieutenant, Johnston was posted to the 2nd US Infantry. Moving through posts in New York and Missouri, Johnston married Henrietta Preston in 1829. The couple would produce a son, William Preston Johnston, two years later. With the beginning of the Black Hawk War in 1832, he was appointed as chief of staff to Brigadier General Henry Atkinson, the commander of US forces in the conflict. Though a well-respected and gifted officer, Johnston was forced to resign his commission in 1834, to care for Henrietta who was dying of tuberculosis. Returning to Kentucky, Johnston tried his hand at farming until her death in 1836. Texas Revolution Seeking a fresh start, Johnston traveled to Texas that year and quickly became embroiled in the Texas Revolution. Enlisting as a private in the Texas Army shortly after the Battle of San Jacinto, his prior military experience allowed him to swiftly advance through the ranks. Shortly thereafter, he was named aide-de-camp to General Sam Houston. On August 5, 1836, he was promoted to colonel and made adjutant general of the Texas Army. Recognized as a superior officer, he was named commander of the army, with the rank of brigadier general, on January 31, 1837. In the wake of his promotion, Johnston was prevented from actually taking command after being wounded in a duel with Brigadier General Felix Huston. Recovering from his injuries, Johnston was appointed Secretary of War by Republic of Texas President Mirabeau B. Lamar on December 22, 1838. He served in this role for a little over a year and led an expedition against Indians in northern Texas. Resigning in 1840, he briefly returned to Kentucky where he married Eliza Griffin in 1843. Traveling back to Texas, the couple settled on a large plantation named China Grove in Brazoria County. Serving as the regiments colonel, the 1st Texas took part in Major General Zachary Taylors campaign in northeastern Mexico. That September, when the regiments enlistments expired on the eve of the Battle of Monterrey, Johnston convinced several of his men to stay and fight. For the remainder of the campaign, including the Battle of Buena Vista, Johnston held the title of inspector general of volunteers. Returning home at the wars end, he tended to his plantation. Photograph Source: Public Domain The Antebellum Years Impressed with Johnstons service during the conflict, now-President Zachary Taylor appointed him a paymaster and major in the US Army in December 1849. One of the few Texas military men to be taken into regular service, Johnston held the position for five years and on average traveled 4,000 miles a year discharging his duties. In 1855, he was promoted to colonel and assigned to organize and lead the new 2nd US Cavalry. Two years later he successfully led an expedition into Utah to confront the Mormons. During this campaign, he successfully installed a pro-US government in Utah without any bloodshed. In reward for conducting this delicate operation, he was brevetted to brigadier general. After spending much of 1860, in Kentucky, Johnston accepted command of the Department of the Pacific and sailed for California on December 21. As the secession crisis worsened through the winter, Johnston was pressured by Californians to take his command east to fight the Confederates. Unswayed, he finally resigned his commission on April 9, 1861, after hearing that Texas had left the Union. Remaining in his post until June when his successor arrived, he traveled across the desert and reached Richmond, VA in early September. The Civil War Begins Warmly received by his friend President Jefferson Davis, Johnston was appointed a full general in the Confederate Army with a date of rank of May 31, 1861. The second-most senior officer in the army, he was placed in command of the Western Department with orders to defend between the Appalachian Mountains and the Mississippi River. Library of Congress Though recognized as one of the prewar armys elite officers, Johnston was criticized in early 1862, when Union campaigns in the West met with success. Following the loss of Forts Henry Donelson and the Union capture of Nashville, Johnston began concentrating his forces, along with those of General P.G.T. Beauregard at Corinth, MS, with the goal of striking at Major General Ulysses S. Grants army at Pittsburg Landing, TN. Shiloh Attacking on April 6, 1862, Johnston opened the Battle of Shiloh by catching Grants army by surprise and quickly overrunning its camps. Leading from the front, Johnston was seemingly everywhere on the field directing his men. During one charge around 2:30 PM, he was wounded behind the right knee, mostly likely from friendly fire. Not thinking the injury serious he released his personal surgeon to aid several wounded soldiers. A short time later, Johnston realized that his boot was filling with blood as the bullet had nicked his popliteal artery. Feeling faint, he was taken from his horse and placed in a small ravine where he bled to death a short time later. With his loss, Beauregard ascended to command and was driven from the field by Union counterattacks the next day. Believed to be their best general General Robert E. Lee would not emerge until that summer), Johnstons death was mourned across the Confederacy. First buried in New Orleans, Johnston was the highest-ranking casualty on either side during the war. In 1867, his body was moved to the Texas State Cemetery in Austin.
